NY AG James will move to seize Trump's assets if he does not pay $355 million fraud fine


Trump Attorney Alina Habba, after the ruling, indicated that they would appeal the decision and warned that the verdict would trigger an exodus of businesses from the Big Apple.

New York Attorney General Letitia James on Tuesday indicated that she would ask the court to seize former President Donald Trump's assets, including his real estate properties, if he does not pay the roughly $355 million a judge fined him in her civil fraud case.

Judge Arthur Engoron ruled against Trump in James's case, determining that he was liable for fraud and barred him from serving as an officer or director in a New York firm for three years. James had alleged that Trump manipulated the value of his assets to secure favorable loan terms and lower insurance premiums. Trump's legal team has fumed over the order and vowed to appeal.

Speaking Tuesday on ABC News, James insisted that "f he does not have funds to pay off the judgment, then we will seek judgment enforcement mechanisms in court, and we will ask the judge to seize his assets."

"We are prepared to make sure that the judgment is paid to New Yorkers, and yes, I look at 40 Wall Street each and every day," she added. 40 Wall Street is the address of the Trump Building, which the former president bought decades ago and spent at least $200 million restoring. The building was named a landmark by the New York City Landmarks Preservation Committee in 1998.

Trump Attorney Alina Habba, after the ruling, indicated that they would appeal the decision and warned that the verdict would trigger an exodus of businesses from the Big Apple.

"Given the grave stakes, we trust that the Appellate Division will overturn this egregious verdict and end this relentless persecution against my clients," she said. "Let me make one thing perfectly clear: this is not just about Donald Trump - if this decision stands, it will serve as a signal to every single American that New York is no longer open for business."

I mean, that is actually how fines work. The issue is the fine's existence/amount, the enforcement is pretty normal.

Also depends on when they go after them? What will NY do if a judge orders the material and money returned to Trump after they sieze it early?

Material usually won't be returned. What's supposed to happen is that the money goes into an escrow account very soon after judgement. The appeals process happens, then the escrow account pays out to the winner. This is why he has to pay now, btw.

If he refuses to pay into the escrow account, places are seized and sold off to fund the escrow account. Those places are gone permanently, but the money can be returned to Trump should he win.

The issue is, I think Trump's probably screwed when it comes to the money. It's going to be hard to overturn that, as it's not necessarily legally wrong, just an abuse of the legal system. It legally doesn't matter at all that no one was harmed by Trump's lying about his net worth, nor does it legally matter that lying about your property values is 100% normal in New York, nor does it legally matter that it was only enforced against Trump. It's morally absurd and wrong, but not legally.

His best bet is actually the $83M to Carroll for defamation. That should get tossed IMO.

I think a lot of other businesses are going to actually ally with Trump on this case. They can't be blind to the precedent this sets and the fact that this very likely will also be used against them someday.

Are you high? Manhattan is the most expensive place to own property in the United States, his buildings there are not worthless

When the state has laid out in no uncertain terms that they will take what's yours if they decide they don't like your politics? You're overeager on this one.

NYC is certainly in decline, and this ruling will accelerate that, but there's a long way to go from the heights of property values it was at, before it hits 'worthless.'

Look up property costs in NYC right now, and you'll see that there are people buying and selling, and the value is not zero, or even 'stupidly cheap.'

Actually, property values in New York city are kept high artificially; you talk to people who have actually lived there, and you quickly find out that a lot of the supposedly prime real estate has been left vacant for years, if not decades.

NYC is in the clam before the storm the market there is irrational and every one is left wondering how long it can all possibly last.

When it all crashes down it will be pretty horrible. I say watch the New york stock market if they decide to move operations the city is toast.

It directly contradicts your point. That's leaving aside the fact that your "point" (meaning the second half where you claim Manhattan property is worthless) is completely retarded and inaccurate to begin with.

Sadly, I don't think that will matter legally. See, it's a dangerous political precedent, but it's not a legal precedent. Nothing here is particularly novel, legally speaking. It's just obviously chosen to ruin a man, along with a judge that hates him.

Basically, I've little doubt that Trump is guilty of something, but then, so is every single NY real estate developer. Trump's definitely guilty of a law that shouldn't exist and shouldn't be enforced.

It probably doesn't matter at this point if they seize his property or not, because property in New York is basically worthless now.
