I am going to say wouldn't that be considered double dipping?

My understanding is that it is not under the dual sovereignty doctrine. State and Government can try someone for the same crime, or for different crimes arising from the same facts.

In the territories (PR in particular) my understanding is that this is not true, but obviously not relevant here.

Federal murder laws only apply when in Federal jurisdiction, not everywhere in the US. This is why, for instance, in the Chauvin trial there was talk of charging Chauvin under Federal Hate Crime laws if he walked on the State level charges. The Federal government could not charge him for murder or manslaughter, since those those were under State jurisdiction, but could charge him with Hate Crimes due to those being under Federal jurisdiction.

What would happen if they arrested and charged him anyways; even knowing that they have no legal grounds to do so? I assume it would take some time for someone to step in and stop them; meanwhile, they can toss Rittenhouse in with the January 6th protestors.
