If he's Customs and Border Patrol then he probably wasn't there on official business. The badge may have been a "Do you know who I am?" attempt to avoid getting into trouble for doing something he shouldn't have done in the first place.

Note: Attending a rally is OK. Attracting LEO attention to the degree where they feel it's necessary to arrest you is most definitely not OK. That goes double if you actually are undercover.
