Protecting And Serving: Cop (mis)behavior and consequences general discussion

In practice that would just let the State double dip on fucking people it doesn't like. Judges already defacto side with police, letting them then dismiss cases they don't like and stick them with the bill?

You keep thinking that the courts in general and judges in particular are neutral. This is not the case, they side with the police in almost all circumstances. QI is asmuch an acknowledgement of expected outcome as it is a law.

Thus letting the courts punish claimants as a way of deterring claims is likely just going lead to QI with extra teeth.

I think the insurance idea is more workable. Allows for restitution without admitting fault or culpability. Your house get burnt down because of flashbacks in a noknock raid with the wrong number? Insurance pays out and the PD handle the clown internally for making their premiums go up.
If there is a no knock raid at the wrong house, having tax payers and/or insurance companies pay to fix the victim’s house is woefully insufficient.

No knock raids at the wrong house need to lead to serious jail time in every case. Serious jail time for the people conducting the raid, not for the home owners.

Right now it leads to nothing. Perfect is the enemy of good. Get a system in place to compensate people for obvious fuckups. Then start throwing blame around.

Qualified Immunity should exist to some extent but it needs massive reforms.

Off the top of my head I would require the following:
1) If an officer asserts qualified immunity then his police chief (or whatever the highest ranking cop in his department is) needs to take the stand and personally certify that it is valid. Forcing the boss to publicly stand behind the officer would likely cut down on a lot of the more absurd claims. I mean imagine the chief of police having to stand up in court, under oath, and say that his officer didn't know that they weren't allowed to pocket money from a persons house when serving a warrant.

2) Qualified Immunity moves to an objective reasonableness standard.

3) The plaintiff can bring a motion stating that the Officer is either lying or so stupid that they shouldn't have ever been allowed to be an officer and the judge is required to provide a written determination. Basically a "No, that is just bullshit. No QI for this shit fest." clause. Or, conversely, requiring a judge to publicly say "Yeah, that seems at least plausibly reasonable. I mean who wouldn't think it was ok to tase a handcuffed prisoner in the balls repeatedly and then set a police dog on him?"

---
No Knock Warrants are another, different, mess and also need massive reform.

As for Civil Asset Forfeiture, that should just be ended outright as the blatant Constitutional violation that it is.

Qualified immunity is completely contrary to US legal tradition. US law is built on the concept of Rule of Law, where the law applies to everybody, including the state. What US law does instead of qualified immunity is carve out exceptions for lawful actions into the causes of actions in statute. The Judicial coming up with some form of immunity ex anus in order to compensate for the Legislature being lazy is ripe for abuse, which is exactly what happened.

you know if the officer in question had just let this go hardly any one would have known, now the entire world is going to look at this and say that the autistic girl was most likely right.
Yup.

"Butch lesbian" is a stereotype for a reason, and for a girl/woman having short hair is very hard to pull off without, well, looking like you're gay.

I knew someone in highschool that had rocking blonde hair down to her waist, but then she cut it when we were in Year 10/when we were 15/16. Despite having short, cropped hair, she rocked the look because she still looked incredibly feminine (facial structure, eyes, body build, et cetera). And, no, she wasn't a lesbian -- she was a proper tomboy.

I lost contact with her a year or two after we left school; I do wonder what happened to her.

I miss tomboys. :(
That's why people love the new Lois Lane from the new Superman cartoon: She's an actual tomboy, not a Groomers United weirdo.

The Leftoids can't even pull the "racism card" for ammunition because, although this Lois is Korean-American, no-one gives an utter shit that she's been race-swapped. They (and I) just love the character.

Same deal with Jimmy -- He's now Black from being a White ginger dude (though, you could argue that's another "redheads being erased in media/Hollywood" thing), but he's fucking hilarious. He's also BFF's with Clark since college (and was the first to put together that he's Superman, but he didn't care/was respectful).

Great characters.

I care; and personally, I don't think the show is any good even when you ignore the raceswaps.
