Because his wife has a condition causing bald spots, which is why she shaves her head, and apparently didn't like the joke. Or at least noticed that his wife didn't like the joke (since he seemed to be laughing at first).
They are below the law, just like the elite are above the law. Anarcho-tyranny at its finest.

Heard on the radio this morning that Will Smith would have been charged with a crime if Chris Rock wanted to press the issue.
He should have picked a better way to handle the situation. This could come back to bite him in the ass down the road in his career. Actors have been Black Balled in the past for literally less.

Chris Rock is not going to attempt to jam up Will Smith over this; actually trying to take this to court would make Rock look like a punk and likely damage his cred with his own friends.
There are heirarchies in Hollywood, and Chris Rock is not in a position where his PR would get better making a official matter out of this.
Actually the Local DA can press charges without the Academy or Chris Rocks input. It all depends if a certain DA has political ambition. You never know what is going through the brains of local DAs. This is not even bringing in the fact that Will Smith cussed on Broadcast TV. That is a whole nother animal all together.

...fair enough; ambitious DAs looking to headhunt and increase their rep are a thing.
Still, anyone who actually tried to go after Smith for this would be looked at as overreacting and petty.

Yup. What I heard came from a PD representative. It didn't come from the DA.
As for the cussing? That's a matter for the FCC. If they're unhappy they'll hand the broadcaster a very large fine.
Which Smith could pay out as a gesture of repentance if he wants.

England used to have the Camera stellata (The Star Chamber).
It was established in the 15th century as a court to ensure that "untouchables" could be brought to justice for their crimes.
Sadly, it eventually became a symbol of oppression through the arbitrary use and abuse of power.

the logical part of me says this thing is being blown WAY out of proportion, but I also remember that this is the same upper class who sided with rioters that chanted cops and their families are "pigs in a blanket fry them like Bacon."
if being in the wrong social class is a crime worthy of punishment, why should they be untouchable? The thirst for vengeance is admittedly far stronger than it should be.
