You realize the reasoning shown in that Tweet almost certainly isn't going to hold up at the federal level, right?

I mean for crying out loud, it was a claim of "you didn't file it quickly enough" forgetting that even though the law was signed into effect then it only caused harm just now.
Laches is a long established legal principle, even if the law was uncousntuonal they should have sued back when it was passed. The asked for remedy won't pass the sniff test in any federal court.

As was already shown, all that was dismissed was a request for an in-junction pending appeal and leave to amend.

The portion for leave to amend was also dismissed and that descion was upheld. That case is over.

The problem is that their primary claim isn't centered around injury, specifically alleging a transgression under a statute. It is specifically because they are alleging that Act 77 is unconstitutional under the PA constitution. That is a case that can inherently be brought at anytime because the injury is its very existence not in specific harm. Thus by not doing so, despite the fact it past more than 180 days previously and was in fact the rule under which the primaries were conducted, it terminally weakens their case.

If a law is unconstitutional, it is unconstitutional the day its passed. If they were alleging fraud or any other specific harm as their primary theory, than that lawyer and you might be correct.

That isn’t really the case. It doesn’t matter whether a law is unconstitutional. If you haven’t been harmed then it isn’t able to be contested by you. See for instance all the second amendment cases that get dropped because the moment it starts looking like it is going to go up the chain, the state reverses it’s decision for that applicant only.

Jesus Christ, they really are getting fucking desperate. They're actively trying to get rid of the evidence before they're analyzed.

At this point, I really do think that they need to be held off at gunpoint (yeah, I'll probably get a warning for this, but at this point...)
