It's a little unclear, to be honest; but if that's the case, then his argument makes little sense. The man was deprived of oxygen for nine minutes; the brain starts dying after at best five.

No it doesn't; the argument appears to be that he would have died soon anyways, so what does it matter that the cop killed him a little earlier? That what the cop did was lethal is not in dispute.

I agree, but we can be certain that the defense is going to bring it up in court; assuming a fair trial is even in the cards at this point. Picking that jury is going to be a nightmare.

Personally I'd argue there should be additional penalties levied whenever a cop commits a crime, as they ought to be held to higher standards than the average citizen.

I agree, but the evidence available clearly indicates that a trial should probably take place concerning this incident, once the investigations into it have concluded.
