Edit: The claim is that Kyle conspired to provoke confrontation with the aid of law enforcement.

Wrongful Death is a civil lawsuit, not a criminal one. He was found not guilty beyond a reasonable doubt of the criminal charge of murder.

Wrongful Death, however, is not intended to determine guilt but to determine if the dead person's family deserves monetary compensation. It only requires "probably more likely to have caused the death than not" rather than a reasonable doubt and it applies in cases of negligence or simply taking an action that led to death, not intent. The bar is basically much, much lower and the stakes are money rather than imprisonment.

OJ Simpson is a famous case where he was found not guilty of murder but then also charged with Wrongful Death and ordered to pay tens of millions to Nicole Simpson's family.
 
It‘s an outrageous travesty, but technically they can sue him. It happened with OJ and I had major misgiving about that.

The problems with a lawsuit against Kyle is that Rosenbaum and Huber’s families as well as Gage don’t have anything to lose or even have to spend any money. They’ll have a team of 20 lawyers who normally work for $1000 each working pro bono who don’t care about winning, just hurting Rittenhouse. I don’t think you can sue the families of the dead and Gage doesn’t have money to make it worth it. Rittenhouse can’t even raise money on Go Fund Me and his lawyers are going to want some kind of payout.

Also, civil suits don’t have a presumption of innocence or double jeopardy - people with money and power have far more advantages.

Keep in mind that the people who oppose us have all of the money and power, they can easily hound people into bankruptcy without worrying about money.
