For what it is worth, I think that we should accept the Garland case as precedent; if Bader-Ginsburg dies on or after the date on which Scalia died, she should not be replaced during this term, and instead the empty seat should be used to mobilise opposition against the democrat candidate. Precedent is important for the regular functioning of our government. Of course, the other option would be to correct the issue by appointing Garland; he is much more moderate than Bader-Ginsburg, so it would still be an overall rightward change in the court.
