    Election 2020 Election 2020: It's (almost) over! (maybe...possibly...ahh who are we kidding, it's 2020!)

It's really not "political reasons" when the law does, in fact, specify that it is not lawful to use the courts for a "fishing expedition" when you do not have a prima facie case. On the other hand, the amount of evidence required to meet that bar is intentionally minimal and is literally...

Yes; her assertion in court is that all of her claims were questions rather than factual assertions, and that she expected evidence to surface during legal discovery. Which is totally fine except for the part where she repeatedly made explicit claims to already have substantial evidence, and the...

On the contrary, the silence *was* broken on MKUltra; that's what led to the New York Times publishing allegations that were detailed and specific enough to trigger dual investigations by Congress and the executive branch, and that was even after the CIA purged the records.

I would argue that Farange's split strategy is massively more viable in the loose coalitions of the British parliamentary system as opposed to the two-party establishment equilibrium of the American system.

Yes, but they need 50 votes to do that. This actually swings power towards the moderate/centrist part of the Democrats, because those are the votes they have to compromise to keep in the count.

No switch, they're just the two most conservative Democrats in the Senate, which means they're the two most able to pull concessions from their own party to keep a 50 vote majority on legislative action.

Given what just went down in Pennsylvania, Meeks should not be seated until all challenges are settled. Precedent should be followed consistently and not "whatever benefits my side".

There's paper either way with this system. Either you mark the ballot electronically on the marking machine and it then prints a ballot that is run through the scanning machine, or if the marking machine is malfunctioning, you hand fill an emergency ballot form with ink and it's run through the...

@Greengrass and @Vaermina appear to be talking past each other because they are talking about slightly different things. The ballot workers' manual cited by Greenglass lays out the specific procedure for when a ballot scanner fails, i.e., the voter has unable to scan their in-person ballot...

If all the cases were denied on technicalities of standing, I might agree with you, but the fact is they weren't. Many were dismissed on the plaintiffs failing to present sufficient evidence to establish a prima facie case, while others were retracted by the plaintiffs themselves.

Hawley's challenge will open the floor for debate, but he doesn't have the votes to actually overturn the electoral slates under the procedures laid down by the Electoral Count Act of 1887, as I summarized in a post here a few weeks ago. (The entire purpose of Gohmert's suit is to challenge the...

    Election 2020 Election 2020: It's (almost) over! (maybe...possibly...ahh who are we kidding, it's 2020!)

The tally of electoral college votes is Biden 306, Trump 232. There's no wild cards in play in terms of the electors, and every single court challenge to date has been dismissed for lack of standing, dismissed for lack of evidence presented, or withdrawn by its own plaintiffs. It is not...

    Election 2020 Election 2020: It's (almost) over! (maybe...possibly...ahh who are we kidding, it's 2020!)

Yes. Pence's legal team pointed out that it is nonsensical to sue the Vice President on the argument that he has tolerated a supposedly unconstitutional Congressional restriction of his alleged authority over the electoral count, as opposed to filing suit against Congress to directly challenge...

    Election 2020 Election 2020: It's (almost) over! (maybe...possibly...ahh who are we kidding, it's 2020!)

I think it's reasonable to keep in mind that even Vice President Pence himself opposed the Gohmert lawsuit, and the claimed Constitutional basis for that suit is shaky at best. Even by the most literalist reading of the Constitution, it's an extreme stretch to say that the VP is empowered with...

Resigning is the expected move because members of the Administration aren't even at-will employees, they "serve at the pleasure of the President".

Overpopulation in certain specific areas can still happen without the entire planet being overcrowded, though. But you are certainly correct; Earth is nowhere near reaching a point of fundamental population saturation.

    Election 2020 Election 2020: It's (almost) over! (maybe...possibly...ahh who are we kidding, it's 2020!)

I disagree. It is an entirely normal expectation in politics that if any senior member of the Administration, up to and including the Vice President, has a disagreement with the President on a matter of policy that they are unwilling to compromise on, it is their duty to quietly resign. The...

    Election 2020 Election 2020: It's (almost) over! (maybe...possibly...ahh who are we kidding, it's 2020!)

This is a pretty straightforward preservation of evidence directive, although this is a *very* preliminary order. Note that the judge hasn't actually ordered that the voting machine information must be shown to the plaintiff; he's ordered that the information must be *preserved* pending his...

No, the linked document is a Memorandum Opinion by the trial court judge defending his decision to issue an emergency preliminary injunction in the case at hand, since said injunction has been appealed to the Pennsylvania Superior Court. This is not an actual ruling of the trial court, nor does...

Both sides have made their claims and counter-claims; the evidence remains to be seen, all around. My opinion is that I'm withholding judgement until it plays out in the courts under oath, and I don't think that's an unreasonably partisan angle.
