    Decision of a Judge does not make something legal or not, only acts of legislature do so. As this is a directive from the 4th amendment of the constitution, only an amendment to the constitution could make it legal.

    It wasn't operative for the Warrant. They could and should have included that evidence when asking for the warrant, but they did not do so. Thus the warrant is not legally valid. That is what matters if we are to have rule of law.

    That doesn't matter, the officer did not have enough evidence to get a warrant and the judge rubber stamped it anyway. That is the actual problem.
