A legal youruber I am subscribed too, Legal Eagle just basically called what trump did so he could take the 2 minute pphoto op in front of the church that was almost burned down as a tin pot dictator move. Because 5 minutes before the curfew the police there went and tear gassed and pushed people away from the front gate. Sure they did not give them warnign and sure some of the cops fucked up, but complaiing that because he had armed gaurds doing this for him...when if he had not clared the way he would most likely have been attacked and killed, and sure the photo shoot was not the best, but he at least wanted to go to a place of religious meaning almomst burnt down to show he cares for the people. he freaking.. This guy is also calling these protests both the riots and actual protests, there is a diffrence, and when the Rioters come out at curfew, because they knew the protesters were not going to leave by curfew, they clearend them out.
he also complained a black hawk was flying right aboce the heads of people, in an unsafe way. it is only unsafe if you throw stuff at it. They do that stuff on a dailey training bassis.
I hate what these riots are doing to people.

I may be arguing with him and people about this.

It's complete and utter fiction, and anytime you see people posting that video please post this article to call the idiots out on their false claims.

If Nick is right about their chances on conviction, get ready for another round of riots in a few months. 3rd degree murder is what they can prove. I hope they can find some private communications about planning a murder in discovery, because that is the only way it is gonna stick.

Third degree murder was a stretch, and this is the Second Degree statue.
609.19 MURDER IN THE SECOND DEGREE.
Subdivision 1.Intentional murder; drive-by shootings.
Whoever does either of the following is guilty of murder in the second degree and may be sentenced to imprisonment for not more than 40 years:

(1) causes the death of a human being with intent to effect the death of that person or another, but without premeditation; or

(2) causes the death of a human being while committing or attempting to commit a drive-by shooting in violation of section 609.66, subdivision 1e, under circumstances other than those described in section 609.185, paragraph (a), clause (3).

Subd. 2.Unintentional murders.
Whoever does either of the following is guilty of unintentional murder in the second degree and may be sentenced to imprisonment for not more than 40 years:

As used in this clause, "order for protection" includes an order for protection issued under chapter 518B; a harassment restraining order issued under section 609.748; a court order setting conditions of pretrial release or conditions of a criminal sentence or juvenile court disposition; a restraining order issued in a marriage dissolution action; and any order issued by a court of another state or of the United States that is similar to any of these orders.
Short of them finding a bunch of evidence showing the cop wanted to kill him, or they stack the jury to the point he get's pretty much an automatic appeal, there's no way they will actually get a second degree conviction.

3rd degree is actually the easier one to prove. He would just need to have a "Depraved mind" which could be asserted by the fact that he ignores not only the man is dying but also when he is dead for several minutes.

Slightly easier, but the defense will pull up body cams showing the many times those in custody have lied about or tried to fake such things.

Simple fact is, one of the standard expectations drilled into police officers is that criminal's lie. And overcoming that fact to charge them with murder is almost impossible without evidence directly showing it was intentional.

I like how they cite a "disproportionately high rate at which black people have been killed by police" as an issue, because as far I'm aware no study has actually shown that such a thing exists, there is no racial disparity for use of lethal force by US police.

There is a bit of evidence for arrests and use of force being racially biased, but not shootings or killings.

That's not what depraved mind means.

They might get 2nd degree through the felony murder rule. I'm really not sure what the other crime would be though. Kieth Ellison is not a good prosecutor. The other option is showing that the cop intended for Floyd to die. I'm not sure they can prove that.

No, this is why having elected prosecutors is a good idea: it let's you vote them out. Otherwise they are political appointees and just bad in a different manner. You want the community to have say in how crime is prosecuted.
